Yes, you could tell the man had never read the decision, nor our consitution for that matter.

The sad part is that I can see how he was trying to make a point, but I am more wondering what happened in the chemical reactions amongst his brain cells to convince him that this was actually a something he could use and that would fit the debate context. I mean, if he wanted to talk about judicial activism, there are a million other cases he could have brought up that were a little more relevant, and, maybe, within the last half-century.
